📜 Zitt Communications — Terms & Conditions

1. 📋 Introduction & Acceptance

Welcome to zitt.com.ng (“the Site”), operated by Zitt Communications (“Zitt”, “we”, “us”, “our”), the trading name of Zitt Dimension Solutions Limited, CAC Registration Number 1977076, with registered/office address at Suite 3, Kembi Igbore Plaza, Alishiba Bus/Stop, Sango-Otta, Ogun State, Nigeria.

These Terms & Conditions (“Terms”) govern your access to and use of the Site and any purchase you make from us, whether via the website, WhatsApp, phone, or in person. By browsing the Site, placing an order, or otherwise using our services, you agree to be bound by these Terms. If you do not agree, please do not use the Site or place an order.

These Terms should be read together with our:

which are incorporated into these Terms by reference. Where there is a direct conflict between this document and one of the above, the more specific policy governs the specific subject it covers (e.g., the Returns & Refunds Policy governs returns).


2. 👤 Eligibility

To place an order with Zitt, you must:

  • Be at least 18 years old, or place an order with the involvement/consent of a parent or guardian;
  • Be able to form a legally binding contract under Nigerian law;
  • Provide accurate, current, and complete information when ordering.

Zitt reserves the right to refuse or cancel any order where these conditions are not met.


3. 📦 Products & Product Information

  • Zitt sells 100% genuine, quality-verified two-way radios, communication gadgets, and related accessories, sourced through verified channels — including current-production stock and select models no longer manufactured by the original brand. We do not knowingly sell clones, counterfeit, or unauthorized replica products.
  • We make reasonable efforts to ensure product descriptions, images, specifications, and pricing on the Site are accurate. However, minor variations (e.g., packaging design, accessory bundling by the manufacturer) may occur without notice.
  • Product availability is not guaranteed until an order is confirmed. If an item becomes unavailable after you order, we will notify you and offer a substitute, refund, or the option to wait for restock.
  • Zitt is an authorized reseller partner of Motorola. Other brand names referenced on the Site (e.g., Baofeng) are trademarks of their respective owners, and reference to those brands does not imply an official distributor or representative relationship unless explicitly stated on the product page.

4. 💰 Pricing & Payment

  • All prices on the Site are listed in Nigerian Naira (₦) and are inclusive of applicable taxes unless stated otherwise.
  • Prices are subject to change without notice; the price applicable to your order is the price displayed at the time your order is confirmed.
  • Payment methods accepted:
    • Instant payment via Paystack (card or bank transfer)
    • Cash on Delivery (COD), requiring a 15% non-refundable deposit upfront, per the Shipping & Nationwide Delivery Policy
  • Zitt does not store your full card or bank details; payments are processed securely by Paystack. See our Privacy Policy for details.
  • An order is only confirmed once full payment (prepaid) or the COD deposit is received.

5. 🚚 Delivery

All delivery timelines, zones, fees, free-delivery eligibility, and related terms are governed by our Shipping & Nationwide Delivery Policy, which forms part of these Terms. By placing an order, you agree to the delivery terms set out there, including COD deposit forfeiture rules, failed-delivery procedures, and force majeure provisions.


6. 🔁 Returns, Refunds & Product Guarantee

All returns, replacements, and refunds — including our 7-Day Replacement Guarantee for factory faults — are governed by our Returns & Refunds Policy, which forms part of these Terms.


7. 🔒 Privacy & Data Protection

Our collection, use, and protection of your personal data is governed by our Privacy Policy, which forms part of these Terms. By using the Site or placing an order, you consent to the data practices described there, including the use of Google Analytics (Site Kit), Meta Pixel, and hosting of Site data outside Nigeria as disclosed in that policy.


8. 🖥️ Use of the Site

You agree to use zitt.com.ng only for lawful purposes. You must not:

  • Use the Site in any way that could damage, disable, overburden, or impair it, or interfere with any other party’s use of the Site;
  • Attempt to gain unauthorized access to any part of the Site, other accounts, or our systems;
  • Use any automated system (bots, scrapers) to access the Site without our prior written consent;
  • Submit false, misleading, or fraudulent information when placing an order;
  • Use the Site to transmit any harmful code, virus, or malicious software;
  • Place orders with the intent to abuse our Cash-on-Delivery, return, or refund processes (see Sections 6–7 of the Delivery Policy and Section 4 of the Returns & Refunds Policy for specific consequences).

Zitt reserves the right to suspend or terminate access to the Site, or refuse to fulfill orders, for any user found in breach of this section.


9. 🏷️ Intellectual Property

All content on zitt.com.ng — including text, graphics, logos, product images, and site design — is the property of Zitt Communications or its licensors and is protected by applicable Nigerian and international intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any Site content without our prior written permission, except for personal, non-commercial use (e.g., saving a product image to help you decide on a purchase).

Third-party trademarks (e.g., Motorola, Baofeng) referenced on the Site remain the property of their respective owners.


10. ⚠️ Disclaimers & Limitation of Liability

  • The Site and its content are provided “as is” and “as available.” While we take reasonable care to keep information accurate and the Site functioning properly, we do not guarantee that the Site will be uninterrupted, error-free, or entirely secure.
  • Product warranties beyond our 7-Day Replacement Guarantee (e.g., manufacturer warranties) are governed by the terms of the relevant manufacturer, where applicable, and not by Zitt directly, unless otherwise stated.
  • To the fullest extent permitted by Nigerian law, Zitt’s total liability arising from any order, whether in contract, tort, or otherwise, is limited to the amount you paid for that order, consistent with the liability cap stated in our Shipping & Nationwide Delivery Policy and Returns & Refunds Policy.
  • Zitt is not liable for indirect, incidental, or consequential losses, including loss of profit, loss of business, or loss of data, arising from your use of the Site or a purchase from us.
  • Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited under Nigerian law.

11. 🛡️ Indemnification

You agree to indemnify and hold Zitt Communications, its staff, and Zitt Logistics (our in-house delivery arm) harmless from any claim, loss, liability, or expense (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Site, or any information you provide that is false or misleading.


12. ⚖️ Governing Law & Dispute Resolution

  • These Terms are governed by and construed in accordance with the laws of the Federal Republic of Nigeria.
  • In the event of a dispute, we encourage you to first contact our Customer Support team (Section 15) so we can attempt to resolve the matter informally.
  • If a dispute cannot be resolved informally within 30 days of first being raised, it shall be referred to and finally resolved by arbitration in accordance with the Arbitration and Mediation Act 2023 (Nigeria).
    • The arbitration shall be conducted by a single arbitrator, appointed by agreement of the parties or, failing agreement within 14 days, appointed by any competent court sitting in Lagos State or Ogun State, upon application by either party.
    • The seat of arbitration shall be Ogun State, Nigeria, and proceedings shall be conducted in English.
    • The arbitrator’s award shall be final and binding on both parties, subject only to such limited rights of appeal or challenge as are available under Nigerian law.
    • Nothing in this clause prevents either party from seeking urgent interim or injunctive relief from a court of competent jurisdiction in Nigeria where necessary to protect its rights pending the outcome of arbitration.

13. 🌩️ Force Majeure

Zitt shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from circumstances beyond its reasonable control, including but not limited to natural disasters, strikes, civil unrest, government action, or disruptions affecting Zitt Logistics’ delivery operations, consistent with the Force Majeure provisions in our Shipping & Nationwide Delivery Policy.


14. 🔄 Changes to These Terms

We may update these Terms from time to time to reflect changes in our business practices or legal requirements. The “Effective Date” at the top of this page will be updated accordingly. Continued use of the Site or placing an order after changes take effect constitutes your acceptance of the revised Terms. Material changes will be communicated where required by law.
